The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the "Regulation"), and Act No. 18/2018 Coll. on the protection of personal data and on amendments to certain acts, as amended.

1. Definitions

Data subject: A natural person (a consumer and a self-employed person) to whom the personal data relates (also "you" or "the customer").

Personal data: Any information about an identified or identifiable customer; an identifiable customer is a natural person who can be identified directly or indirectly, in particular by reference to a certain identifier, for example a name, identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person (also "data" or "information").

Controller: The entity that determines the purposes and means of processing personal data, carries out the processing and is responsible for it. The controller of personal data is Jesenius 07, s.r.o. (also "we").

Processor: The entity that, on the basis of law or on the instructions of the controller, processes personal data for the controller, on the basis of a personal data processing agreement (also "business partner" or "partner").

Purpose of processing personal data: The reason why personal data is processed. Such a reason may be, for example, performance of a contract, administration of user accounts, handling of enquiries and complaints, sending informational newsletters or displaying advertising based on customers' interests.

This is a string of characters assigned by websites and servers to the browser that stored the cookie. This allows websites and servers to distinguish and identify individual browsers. Cookies are used to improve the functioning of the website, to evaluate its traffic and for the purpose of better targeting of marketing activities. If you browse our website, we assume that you agree to the use of these files.

Third countries: Countries outside the European Economic Area, which primarily comprises the member states of the European Union together with Iceland, Liechtenstein and Norway.

We and our contractual processors, in connection with the relevant legal basis and purpose of processing, process the following personal data or categories of personal data:

other personal data related to the contractual relationship: bank account number, order history;
other personal data: typically data provided by the customer in the order form or in other documents and when communicating with us, including later updates.

3. What is the origin of the personal data?

We process data that you provide to us, for example when ordering our services, registering a user account, communicating with us or subscribing to newsletters. This typically involves:

identification and address data;
electronic contact data;
other personal data related to the contractual relationship.

5. How long is personal data processed?

for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and us and to assert claims from these contractual relationships (4 years);
for the period necessary to fulfil a legal obligation (accounting documents 5 years, tax documents 10 years);
for the duration of our legitimate interest in sending informational newsletters (2 years from the last opening of an informational newsletter);
for the duration of your consent (at most 4 years from the granting of consent, or 4 years from the last order).

7. Is personal data transferred outside the EU?

The controller intends to transfer personal data to a third country (outside the European Economic Area) or to an international organisation. Recipients of personal data in third countries are:

8. How is personal data processed?

Personal data is processed both manually and automatically. We keep proper records of all processing activities in accordance with the relevant legal regulations.

You are not subject to any decision based solely on automated processing, including profiling, which would produce legal effects concerning you or similarly significantly affect you. We do not create profiles from your personal data for the purpose of analysing or predicting your preferences, interests, economic situation, reliability, location or movements (a typical example of profiling is monitoring the behaviour of website visitors in order to track their preferences so that a trader can approach them in the future with an offer tailored specifically to them).

The right of access to personal data.
The right to rectification of inaccurate personal data and completion of incomplete personal data.

The right to data portability.
The right to object to processing.
The right to information about automated decision-making, including profiling.

If we process your personal data on the basis of your consent, you have the right to withdraw that consent at any time.

10. How are cookies processed?

The cookies processed can be divided according to validity into:

temporary cookies (so-called session cookies), which remain stored in your browser only until you close your browser,
persistent cookies (so-called persistent cookies), which remain stored in your browser for a long time until their lifetime expires or until you manually remove them (the storage period of cookies in your browser depends on the settings of the cookie itself and the settings of your browser).

And according to function into:

essential, which are necessary for the functionality of our website,
preference, which allow our website to remember information that changes how the website behaves or looks (e.g. the preferred language or the region where you are located); these cookies are not strictly necessary for the functioning of our website, but they increase its functionality and ease of use,
analytics, which help us analyse your experience on our website (so-called User Experience) and thanks to which we understand how you use our website.

We do not use third-party cookies that track across multiple websites in order to provide you with personalised content and advertising on third-party websites and other sales channels.

11. Is data about children also processed?

Our website is not intended for children under 16 years of age. We therefore do not intentionally collect their personal data. If we find that we have inadvertently obtained personal data about children under 16, we will take steps to delete this data as quickly as possible, except in cases where we are bound by the relevant law to retain it.
